Personal data processing and privacy policy

1. General Provisions

This policy on processing and confidentiality of personal data has been compiled in accordance with the requirements of Federal Law No. 152‑FZ "On Personal Data" dated July 27, 2006, and determines the procedure for processing personal data and the measures to ensure personal data security implemented by "YugMax" LLC (hereinafter referred to as the Operator), and applies to all information that this website may obtain about the User, as well as any programs and products hosted on it.

1.1. Operator sets ensuring personal human and civil rights, including the protection of rights to privacy, personal and family secrets as a top priority goal and condition during its own business activities.

1.2. This Operator’s policy regarding the processing and confidentiality of personal data (hereinafter referred to as the — Policy) applies to all information that the Operator may obtain about visitors to the website https://yugmax.com.

2. Key Terms Used in the Policy

2.1. Automated processing of personal data is defined as computer-aided processing of the personal data.

2.2. Blocking of personal data means a temporary suspension of personal data processing (except when processing is required to clarify personal data).

2.3. Website refers to a set of graphic and information content, as well as software and databases ensuring their availability on the Internet at https://yugmax.com.

2.4. Personal data information system means the combination of personal data contained in databases, along with the information technologies and technical means enabling the processing of such data.

2.5. Depersonalization of personal data means actions as a result of which it is impossible to determine, without additional information, the affiliation of personal data to a specific User or other personal data subject.

2.6. Processing of personal data — any action (operation) or set of actions (operations) performed with or without automation tools involving personal data, including collection, recording, organization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.

2.7. Operator is defined as a state or municipal authority, legal entity, or individual who, alone or jointly with other parties, organizes and/or conducts the processing of personal data, and determines the purposes of processing personal data, the categories of personal data to be processed, and the actions (operations) performed on such data.

2.8. Personal data refers to any information relating directly or indirectly to a specific or identifiable User of the website https://yugmax.com.

2.9. Personal data permitted by the personal data subject (User) for distribution are defined as personal data to which access is granted to an unlimited number of persons by the personal data subject’s consent to processing and dissemination, as stipulated by the Personal Data Law.

2.10. User means any visitor to the website https://yugmax.com.

2.11. Provision of personal data implies actions aimed at disclosing a User’s personal data to a specific person or defined group of persons.

2.12. Dissemination of personal data refers to any actions aimed at disclosing a User’s personal data to an unspecified number of persons (transfer of personal data) or making personal data available to an unlimited number of persons. This includes, inter alia, the publicizing of personal data on mass media, the placement thereof on information and telecommunications networks, or the provision of access thereto by any other method.

2.13. Cross-border transfer of personal data implies transfer of a User’s personal data to the territory of a foreign state, to a foreign state authority, foreign individual, or foreign legal entity.

2.14. Destruction of personal data refers to any actions resulting in the irreversible destruction of a User’s personal data preventing any further restoration of the content in the personal data information system and/or destruction of material media containing personal data.

2.15. Confidentiality of personal data — the Operator’s mandatory requirement to prevent the intentional disclosure of personal data without the personal data subject’s consent or other legal basis.

3. General Provisions

3.1. The Privacy Policy governs the procedure for processing Users' personal data, including for the purpose of ensuring the security of personal data processing and protecting their rights and interests during the processing of personal data.

3.2. By using this website, you agree to this Privacy Policy and to the terms of personal data processing.

3.3. If the User disagrees with the terms of the Policy, the User must cease using the website.

3.4. This Policy applies only to this website. The Operator does not control and is not responsible for third-party websites that the User may access via links available on this site.

3.5. The website Operator does not verify the accuracy of personal data provided by the User.

3.6. All individuals who have submitted personal data on the website, as well as those who have posted other information through such actions, confirm their consent to the processing of personal data and to its transfer to the personal data processing Operator.

4. Subject of the Privacy Policy

4.1. This Privacy Policy establishes the Operator’s obligations for intentional non-disclosure of personal data provided by the User in response to various requests from the Operator (e.g., during site registration, submission of applications/requests, subscription to notifications, etc.).

4.2. The personal data permitted for processing under this Policy are provided by the User by filling out an application on the Site, and include the following information:

— the User’s full name;
— the User’s contact phone number;
— the User’s email address;
— other information relating to the User’s identity that is available or known to the Operator at any given time.

4.3. The Operator also takes measures to protect personal data that are automatically transmitted during the site visit process, including:

— IP address;
— cookie information;
— information about the browser (or other program) accessing the site;
— access time;
— visited page URLs;
— referrer (previous page URL).

4.4. Disabling cookies may result in the inability to access the site.

4.5. The Site collects statistics on the IP addresses of its visitors. This information is used to identify and resolve technical issues and to monitor the accuracy of ongoing operations.

5. Operator’s Main Rights and Obligations

5.1. The Operator shall have the right:

— to obtain accurate information and/or documents containing personal data from the personal data subject;
— in case of withdrawal of consent to personal data processing by the personal data subject, as well as upon submission of a request to terminate data processing, the Operator shall have the right to continue processing personal data without the subject’s consent if there are legal grounds provided by the Personal Data Law;
— to independently determine the scope and list of measures necessary and sufficient to ensure the fulfillment of obligations stipulated by the Personal Data Law and its implementing regulations, unless otherwise provided by federal law;

5.2. The Operator shall be obliged to:

— to provide the personal data subject, upon request, with information regarding the processing of their personal data;
— to organize the processing of personal data in accordance with the procedures established by applicable Russian law;
— to respond to inquiries and requests from personal data subjects and their authorized representatives in accordance with the Personal Data Law;
— to provide the authorized personal data protection authority, upon request, with the necessary information within 10 days of receipt;
— to publish or otherwise ensure unlimited access to this Personal Data Processing Policy;
— to implement legal, organizational, and technical measures to protect personal data from unauthorized or accidental access, destruction, alteration, blocking, copying, disclosure, or other illegal actions;
— to cease transfer (dissemination, provision of access), processing, and destruction of personal data in the manner and cases stipulated by the Personal Data Law;
— to fulfill other obligations provided for by the Personal Data Law.

6. Main Rights and Obligations of Users as Personal Data Subjects

6.1. Users, as personal data subjects, shall have the right:

— to obtain information regarding the processing of their personal data, except as provided by federal law. Information shall be provided in an accessible form and shall not contain data about other subjects, unless legally permitted. The list of information and the procedure for obtaining same are stipulated by the Law on Personal Data.
— to demand that the Operator clarify their personal data, block or destroy it if the data is incomplete, outdated, inaccurate, illegally obtained, or not necessary for the declared processing purpose, and to take legal measures to protect their rights;
— to stipulate prior consent when processing personal data for the purpose of marketing goods, works and services;
— to withdraw consent to personal data processing and submit a request to terminate processing;
— to appeal to the authorized personal data protection authority or the courts against unlawful actions or inaction by the Operator in processing their personal data;
— to exercise other rights provided by Russian legislation.

6.2. Users, as personal data subjects, shall be obliged to:

— to provide the Operator with accurate information about themselves;
— to inform the Operator of any clarifications (updates, alterations) to their personal data.

6.3. Individuals who provide inaccurate information about themselves or information about another personal data subject without the latter’s consent shall bear liability under Russian legislation.

7. Principles of Personal Data Processing

7.1. Personal data processing shall be conducted on a legal and fair basis.

7.2. Personal data processing is limited to achieving specific, predetermined, and lawful purposes. Processing personal data incompatible with the purposes of data collection is not permitted.

7.3. Combining databases containing personal data processed for incompatible purposes is not permitted.

7.4. Only personal data that meet the purposes of their processing shall be subject to processing.

7.5. The content and scope of processed personal data shall correspond to the stated purposes of processing. Excessive processing of personal data beyond the declared purposes is not allowed.

7.6. Personal data processing ensures the accuracy and sufficiency of the data, and where necessary, their relevance to the purposes of processing. The Operator shall take or ensure the taking of necessary measures to delete or clarify incomplete or inaccurate data.

7.7. Personal data shall be stored in a form permitting identification of the data subject no longer than required for the purposes of data processing, unless a storage period is established by federal law, a contract to which the data subject is a party, beneficiary, or guarantor. Processed personal data shall be destroyed or depersonalized upon the achievement of processing purposes or if those purposes are no longer relevant, unless otherwise provided by federal law.

8. Purposes of Use and Processing of Personal Data

8.1. Purposes of use and processing:

— to enter into and execute agreements, contracts, and other arrangements with the Operator posted on the website, as expressly provided by this Policy;
— to provide the User with access to personalized website resources;
— to inform the User about services/products and ongoing incentive programs;
— to determine the User’s location for security and fraud prevention;
— to verify the accuracy and completeness of personal data provided by the User;
— to send press releases to the User’s email address;
— to provide the User with efficient customer service and technical support for website-related issues;
— to deliver service updates, special offers, pricing information, newsletters, and other communications on behalf of the website or its partners;
— to carry out advertising activities;
— to conduct analytics and marketing research;
— to inform the User via email.

8.2. Personal Data:

8.3. Legal basis: the Operator’s charter (founding) documents.

8.4. Types of personal data processing: sending informative notes to the email address.

9. Conditions for the Processing of Personal Data

9.1. The processing of personal data is carried out with the consent of the personal data subject to the processing of their personal data.

9.2. The processing of personal data is necessary for achieving purposes stipulated by an international treaty of the Russian Federation or by law, for the exercise of functions, powers, and obligations assigned to the operator by Russian Federation legislation.

9.3. The processing of personal data is necessary for the administration of justice, the execution of a judicial act, or an act of another authority or official, subject to execution in accordance with the legislation of the Russian Federation on enforcement proceedings.

9.4. The processing of personal data is necessary for the performance of a contract to which the personal data subject is a party, beneficiary, or guarantor, as well as for the conclusion of a contract at the initiative of the personal data subject or a contract under which the personal data subject will be a beneficiary or guarantor.

9.5. The processing of personal data is necessary to exercise the rights and legitimate interests of the operator or third parties, or for the achievement of socially significant goals, provided that this does not violate the rights and freedoms of the personal data subject.

9.6. Processing is carried out for personal data to which an unlimited scope of persons have access, provided by the personal data subject or at their request (hereinafter — publicly available personal data).

9.7. Processing is carried out for personal data that must be published or mandatorily disclosed under federal law.

10. Procedure for the Collection, Storage, Transfer, and Other Types of Processing of Personal Data

The security of personal data processed by the Operator is ensured through legal, organizational, and technical measures necessary to fully comply with current legislation in the field of personal data protection.

10.1. The User’s personal data is processed by any legal means, including in personal data information systems using automation tools or without such tools, by storing, recording on electronic media, and maintaining lists. The list of processing methods given above is not limiting.

The Operator ensures the security of personal data and takes all possible measures to prevent unauthorized persons from gaining access to personal data.

10.2. The User’s personal data will never, under any circumstances, be transferred to third parties, except in cases related to compliance with applicable legislation, or if the personal data subject has given consent to the Operator to transfer data to a third party to fulfill obligations under a civil law contract.

The User agrees that the Operator has the right to transfer personal data to third parties in order to fulfill the User’s requests submitted on the site in the following cases:

— the transfer is necessary for the User to use a particular Service, or for the performance of a contract/agreement concluded with the User or a person whom the User represents;
— the transfer of personal data is provided for by applicable law under established procedures;
— the transfer takes place as part of the sale or other transfer of the business (in whole or in part), in which case the acquirer assumes all obligations to comply with the terms of this Policy regarding the received personal data;
— to ensure the ability to protect the Operator’s rights and legitimate interests if the User violates the terms of this Policy and/or a concluded contract/agreement;
— to ensure compliance with the current legislation of the Russian Federation (including for the purpose of preventing and/or stopping illegal and/or unlawful actions).

10.3. If inaccuracies in personal data are detected, the User may update them independently by sending a notification to the Operator’s email address info@yugmax.com with the note "Personal Data Update".

10.4. The period for processing personal data is determined by achieving the purposes for which the personal data was collected, unless a different period is specified by contract or applicable law.

The User may at any time withdraw their consent to the processing of personal data by sending a notification to the Operator’s email address info@yugmax.com with the note "Withdrawal of consent to the processing of personal data".

10.5. All information collected by third-party services, including payment systems, communications tools, and other service providers, is stored and processed by these parties (Operators) in accordance with their User Agreement and Privacy Policy.

The Operator is not responsible for the actions of third parties, including the service providers specified in this paragraph.

10.6. Restrictions imposed by the personal data subject on transfer (excluding granting access) and on the processing (excluding obtaining access) of personal data authorized for dissemination, do not apply in cases where personal data is processed for state, public, and other public interests as determined by the legislation of the Russian Federation.

10.7. The Operator ensures the confidentiality of personal data when processing personal data.

10.8. The Operator stores personal data in a form that allows identifying the personal data subject, no longer than required by the purposes of personal data processing, unless a storage period is established by federal law, or by an agreement to which the personal data subject is a party, beneficiary, or guarantor.

10.9. Grounds for terminating the processing of personal data may include achieving the purposes of processing, expiration of the consent period, withdrawal of consent by the personal data subject, or detection of unlawful processing of personal data.

11. List of Actions Performed by the Operator with Received Personal Data

11.1. The Operator performs the collection, recording, systematization, accumulation, storage, updating (modification, change), retrieval, usage, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.

11.2. The Operator carries out automated processing of personal data with or without the receipt and/or transmission of the obtained information via information and telecommunication networks.

12. Cross-Border Transfer of Personal Data

12.1. Before beginning cross-border transfer of personal data, the Operator must notify the authorized body for the protection of personal data subjects' rights of its intention to carry out such transfer (such notification shall be sent separately from the notice of intent to process personal data)

12.2. Before submitting the above notification, the Operator is obliged to obtain relevant information from the authorities of the foreign state, foreign individuals, or foreign legal entities to whom the cross-border transfer of personal data is planned.

13. Confidentiality of Personal Data

The Operator and other persons who have access to personal data must not disclose or distribute personal data to third parties without the consent of the personal data subject, unless otherwise provided by federal law.

14. Final Provisions

14.1. The User may obtain any clarifications on matters concerning the processing of their personal data by contacting the Operator via email at info@yugmax.com.

14.2. The Operator may amend this Policy without the User’s consent. The amended version of the Policy shall enter into force upon its publication on the Site, unless otherwise provided by the new version of the Policy. The Policy is effective indefinitely until replaced by a new version.

14.3. The current version of the Policy is publicly available online at https://yugmax.com/privacy-policy.
